Detroit Federal Judge Chooses Constitution over Bush Wire tapping

Judge Anna diggs Taylor sits on the US District Court in Detroit.  She was appointed during the Carter administration.  She ruled that the governments wiretapping program of international communications violated the constitution.  Her ruling does not impact the wiretapping of national communications nor does it impact the NSA's monitoring of internet communications from web searches, to emails to surfing habits, messaging and more.

The Argus of InsideBayArea.com quoted her as stating,

"The public interest is clear in this matter," Taylor wrote. "It is the upholding of our Constitution."

In bypassing court warrants, the judge said, the government has sought the unilateral power to decide when surveillance is required.

"It was never the intent of the framers to give the president such unfettered control, particularly when his actions blatantly disregard the parameters clearly enumerated in the Bill of Rights," she wrote. "The three separate branches of government were developed as a check and balance for one another."
